2. Services provided at MovieMusicMan

The service provider offers Royalty-Free-Music, which can be licensed online at www.moviemusicman.de. By licensing music via www.moviemusicman.de, a license agreement is concluded between the service provider and the purchaser in accordance with these General Terms and Conditions.

3. Scope of application

The following General Terms and Conditions apply to the use of the website www.moviemusicman.de including the MovieMusicMan music library service. When visiting www.moviemusicman.de these Terms and Conditions and the Privacy Policy of MovieMusicMan apply to your use. If you do not want to be bound by the above mentioned terms, please do not visit this website and do not use the Service of MovieMusicMan.

A consumer is any natural person who concludes a legal transaction for purposes which can predominantly neither be attributed to his commercial nor to his self-employed professional activity. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his commercial or self-employed professional activity.

4. License types

The service provider offers the following license types. All licenses are Non-Exclusive. Use of a work that is not covered by any of these license types requires a separate expressly written agreement. The offered licence types on www.moviemusicman.de may may be subject to change in the future without further notice. Changes to the license terms and prices however will be announced on www.moviemusicman.de and will apply to new purchases from there on.

4.1 Non Advertising License

Non-Exclusive License for use in a single production or episode

Non-advertising film, video, movie, trailer, theatre, dance performance, video installation

Worldwide use, including Internet publication, unlimited in time

4.2 Advertising License

Non-Exclusive License for use in a single advertisement

Advertising film, video, commercial, Point of Sale, POS-video, presentation, teaser

Worldwide use, including Internet publication, unlimited in time

5. Prices

Unless otherwise stated, all prices on www.moviemusicman.de are in USD

All prices are without VAT. According to §19 German Tax Law Ch.246-253, small business provision

6. Payment

The following payment options are available to consumers:

Paypal
Paypal with credit card
Western Union
Bank Transfer

If payment is made via "Western Union" or "Bank Transfer", the buyer will be charged an additional additional handling fee.

7. Conclusion of contract

The music offered for licensing by the provider on www.moviemusicman.de constitutes a proposal to the purchaser to license the works. With the execution of the order by clicking the "pay now" button at PayPal, a binding license agreement is concluded. Immediately after sending the order, the purchaser will receive a confirmation by email that the contract has been concluded.

8. Delivery

After receipt of the payment on the provider's account the buyer receives a download link to the uncompressed music file by email. The uncompressed original music file will be a 48kHz 16Bit stereo WAV file.

After expiry of the withdrawal period of fourteen days from the date of conclusion of the contract and if the buyer does not exercise his right to withdraw, the customer will receive a personal license certificate.

9. Liability

When using the Services, you must not:
Use the licensed music in a way that is outside of the scope of the license.
Violate any applicable local, state, national, or international law and any regulations having the force of law, whether intentionally or unintentionally.
Use the licensed music with a production that is unlawful, harmful, threatening, harassing, abusive, tortious, defamatory, vulgar, obscene, libelous, hateful, or racially, ethnically or otherwise objectionable.
